Definitions
In this Agreement, the following capitalised words have these specific meanings:

‘Website’ means the Kjaer Academy Website – kjaer-academy.com.
‘Course’ means any class, Course, webinar or talk available for purchase through the Website.
‘Service(s)’ means any content – free or purchased for a fee – offered to you though the Website.
‘Terms’ means the Terms & Conditions for use of Service(s) as specified on this webpage.

In addition, ‘we’, ‘us’ and ‘our’ means Kjaer Global limited and/or the Service(s) of Kjaer Academy.

We may make changes to the Terms of this Agreement. Depending on the nature of the change, we will post the changes at the top of this page, indicating the date these Terms were revised, and/or notify you through the Services’ user interface, in an email notification or by applicable law as required. Any such changes will become effective no earlier than 14 days after they are posted, except for changes addressing new functions of the Services or changes made for legal reasons, which will be effective immediately. Continued use of the Service after the date any such changes become effective constitutes your acceptance of the new Terms.

Agreement
Before you start using kjaer-academy.com and all linked pages on the Website, including Course material, we advise you to read, understand and agree to these Terms. By accessing the Website, viewing any content or using any Services available on the Website you are agreeing to be bound by these Terms, which together with our Privacy Policy, govern our relationship with you. If you are using our Services on behalf of a business, the same conditions apply and that business agrees and is bound by the Terms of this agreement.

Description of Site
The Website kjaer-academy.com is an online inspirational learning platform and a community for individuals and teams. The main purpose of the Service is to provide learning content in the form of inspiration and information and act as a community platform for learners. The Website may enable users to contribute and connect to other users, post photographs, images, videos and audio, share comments, opinions, knowledge and ideas or participate in assignments, challenges, contests and promotions. Services include, but are not limited to, any Course, class and/or content Kjaer Academy makes available to you, the user. Content includes, but is not limited to, text, audio, video, information, data, graphics, news articles, images, illustrations, and user generated content including, but not limited to, user comments, coursework, text, images, video, audio and messages.

Kjaer Academy Courses, and any other content viewed through our Service, are solely for your personal and non-commercial use. A Kjaer Academy Course purchase, or any other purchase made through the website, will grant you a non-exclusive, non-transferable, licence to access the Kjaer Academy Course content. No right, title or interest is transferred to you or your business.

Registration and accounts
You may need to create an account with Kjaer Global limited in order to use some of our Services. For that purpose, you will be required to select a password and username, and to provide registration information. The registration information you provide must be accurate, complete, and current. Failure to provide or update correct information constitutes a breach of the Terms, which may result in termination of your account.

Your user name must not be any of the following: the name of another person or entity that is not lawfully available for your use; the name or trademark of another person or entity without appropriate authorisation; a name that in any manner misleads readers into thinking that you are another person, entity or company; a name that may be judged offensive, vulgar or obscene.

It is your responsibility to keep your login credentials secure and you are solely responsible for all activities related to your account. You must notify Kjaer Global limited of any unauthorised uses of your account or any other breaches of security. Kjaer Global limited will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.

You may not use another user’s account, and you may not provide another person with the username and password to access your account. You are fully responsible for any and all activities that occur under your password and account. It is your responsibility to ensure that your password remains confidential and secure.

Services are available only to individuals who are at least 16 years old. Parents and legal guardians are required to authorise purchases and use of Services by individuals under the age of 18.

Fees
Where the Service or any portion thereof is made available for a fee – e.g., if you purchase access to a Course through the Website – you will be required to select a payment method and provide credit card or other payment details. You represent and warrant to Kjaer Global limited that your information is true and that you are authorised to use the payment method you provide. The payment information must be accurate, complete and current. You agree to pay Kjaer Global limited the amount that is specified for the Service (e.g. a Course or class), as well as any applicable taxes. If you dispute any charges you must let Kjaer Global limited know within 30 days from the date of the charge. You are responsible for all taxes associated with the Services you purchase, other than taxes specified as included in the Service price at time of purchase. Kjaer Global limited reserves the right, at any time, to change fees or charges for using any Services on the Website or to begin charging fees for any Service. Fees or charges will not be applied retrospectively, i.e., to goods or Services used or purchased before fees were introduced.

Refund and credits
If the Course you purchased is not what you were expecting, you should write to us within 7 days of purchase to detail why and request a cancellation and refund. Kjaer Global limited reserve the right to apply your refund as a refund credit or as a refund to your original payment method, at our discretion. At our discretion, if we believe you are abusing our refund policy, we reserve the right to deny your refund and/or restrict all future use of our Services. Instances where we reserve the right to refuse a refund or limit access to Services include refunds requested repeatedly for different Courses, or requested after significant portions of a Course has been completed.

At any time, and for any reason, we may provide a refund, discount or other consideration to some or all of our users. The amount and form of such credits, and the decision to provide them, are at our sole and absolute discretion. The provision of credits in one instance does not entitle you to credits in the future for similar instances and does not imply that we will provide credits in the future in other circumstances.

Modification and Access to Website and Services
Your access to and use of the Website may be interrupted from time to time as a result of equipment malfunction, updating, maintenance or repair of the Website or any other reason within or outside the control of Kjaer Global limited. We reserve the right to suspend or discontinue the availability of the Website and/or any Service and/or remove any content at any time at our sole discretion and without prior notice. We will, endeavour to notify users if any major changes are planned. Kjaer Global limited may also impose limits on certain features and Services or restrict access to parts or all of the Website and Services without notice or liability. Some Services and Courses may have specific terms & conditions applied and you will be notified of these at point of purchase. However, in cases of dispute, these Terms will override other terms & conditions.

Where ‘Lifetime’ access is stated in the agreement for a specific purchase of Service or content, Lifetime means until the Service or content is terminated by Kjaer Global limited.

The Website should not be used or relied upon for storage of your photographs, images, videos, audio or any other content, and you are directed to retain your own copies of all Content posted on the Website.
You agree that Kjaer Global limited will not be liable to you or to any third party for any modification, suspension or discontinuance of the Service. We have no obligation to retain any of Your Account or submitted Content for any period of time beyond what may be required by applicable law.

The Service may provide links or other access points to other sites and resources on the Internet. Kjaer Global limited has no control over such sites and resources and is not responsible for their operation. Nor does a link or other access point imply Kjaer Global limited endorses these sites and resources. Pages describing our Services are accessible from around the world but this does not mean all Services or Service features are available in your country. It is your responsibility to ensure use of Kjaer Global limited Services is legal, appropriate and possible in the country where you live or access them.

Proprietary Rights
Kjaer Global limited is the sole and exclusive owner of all rights related to content and materials on the Website unless rights are specified as belonging to a third party. All the content, including all Course content, is copyright of Kjaer Global or a specified third party, and remains so after your purchase. As such, using the Website does not grant to you ownership or rights over any content, code, data or materials you may access on or through the Website.

Your purchase grants you a licence to access and view the content on the Website on any digital device or platform and, unless otherwise indicated, make copies or prints of the content on the Website for your personal use. Use of the Website, and the Services offered on or through the Website, are for personal and non-commercial use only. For team or group enrolment, Terms will apply to each individual enrolled. All of the above applies to business as well as to individuals purchasing or using Kjaer Global limited Services.
